Terms of Use: Job Safety, Inc.

These Terms of Use ("Terms") govern your access to and use of the services and downloadable materials provided by Job Safety, Inc. ("Job Safety," "we," "us," or "our"), including but not limited to job safety analysis (JSA) templates, pre-task plans (PTPs), toolbox talks, and other safety-related content (collectively, "Content"). By using our platform, whether through paid subscription, free access, or public download, you agree to be bound by these Terms.

 

1. Scope of Use
All Content is provided solely for general informational, training, and educational purposes and to promote safe work practices.


You are responsible for reviewing, customizing, and validating all Content to reflect your specific job site conditions, activities, equipment, regulations, and personnel.


Job Safety, Inc. makes no representations or warranties that any Content satisfies legal, regulatory, insurance, or client-specific requirements.


Use of the Content does not establish a contractual or consulting relationship with Job Safety, Inc.

 

2. Intellectual Property Rights
All content made available through the Job Safety platform—including but not limited to text, templates, training materials, forms, PDF documents, video/audio content, website code, and design elements—is the exclusive property of Job Safety, Inc. or its licensors, and is protected by U.S. and international copyright, trademark, and intellectual property laws.


Users are granted a limited, revocable license to access and use the content solely for internal safety-related purposes. No ownership rights are transferred.


You may not copy, reproduce, modify, display, publish, distribute, reverse engineer, or create derivative works from the content without prior written permission.


Any unauthorized use of Job Safety, Inc.’s intellectual property may result in legal action.

3. License & Content Restrictions
You are granted a limited, non-exclusive, non-transferable license to use the Content within your organization only.


You may not:


Resell, sublicense, or commercially distribute any Content;


Post Content to public websites without written permission;


Modify Content in a way that misrepresents its origin or suggests Job Safety endorsement;


Use Company logos, trademarks, or branding without consent.

 

4. No Certification or Compliance Guarantee
Content provided does not constitute certification, legal advice, or a guarantee of compliance with any law or regulation.


Use of the Content does not guarantee the elimination of hazards, prevention of incidents, or satisfaction of OSHA or other agency requirements.

 

5. Disclaimer of Warranties & Limitation of Liability
All Content is provided "as is" and "as available", without warranties of any kind.


To the fullest extent permitted by law, Job Safety, Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.


In no event shall Job Safety, Inc. be liable for any direct, indirect, incidental, special, or consequential damages, including lost profits or business interruption, arising out of your use of the platform or Content.

 

6. Indemnification
You agree to indemnify, defend, and hold harmless Job Safety, Inc., its affiliates, officers, employees, and agents from any claims, liabilities, damages, or costs (including legal fees) arising out of:


Your use or misuse of the Content;


Your failure to review, modify, or validate materials appropriately;


Any violation of these Terms.

 

7. Access, Termination, and Suspension
We reserve the right to modify, restrict, or revoke access to any portion of the platform or Content at any time.


Access may be provided through paid subscriptions, manual user creation, or public availability (e.g., free toolbox talks).


You may cancel your subscription at any time, but no refunds are offered for unused time.

 

8. Content Updates and Version Control
Content may be revised, updated, or removed at any time without prior notice.


You are responsible for ensuring you use the most current versions of any downloaded materials.

 

9. Privacy
Use of the platform is also governed by our Privacy Policy.


We collect and store only the personal information necessary to provide services, manage accounts, and improve functionality.

 

10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.


Any disputes shall first be subject to informal negotiation; if unresolved, they shall be settled through binding arbitration under the rules of the American Arbitration Association (AAA), to be held in New York, NY.

 

11. Updates to These Terms
We may update or revise these Terms at any time. The most current version will be posted on our website.


Continued use of the platform or Content after such updates constitutes your acceptance of the new Terms.
